OPENPACKETLOSS™ TERMS OF SERVICE & DISCLAIMER

1. Acceptance of Terms
By accessing, browsing, or using the OpenPacketLoss™ website, its associated server software, Docker containers, and mobile application interfaces (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.
2. Description of Service
OpenPacketLoss™ provides users with network diagnostic tools designed to measure packet loss, jitter, latency, and general network stability via WebRTC and UDP protocols. The Service is provided free of charge for both public testing and self-hosted deployments. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. Diagnostic Disclaimer (Use at Your Own Risk)
The Service is provided on an "as-is" and "as-available" basis. Network diagnostic results are strictly for informational, educational, and troubleshooting purposes only.
Network conditions are inherently dynamic and can fluctuate based on factors outside our control, including but not limited to: ISP routing algorithms, local hardware performance, Wi-Fi interference, background device activity, and upstream network congestion. We make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, suitability, or completeness of the test results generated by the Service across any specific platform, device, or network path.
4. Limitation of Liability
To the fullest extent permitted by applicable law, under no circumstances shall OpenPacketLoss™, its creators, developers, contributors, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our testing tools.
This limitation of liability includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses resulting from decisions made based on the metrics generated by this Service. Users acknowledge and agree that any hardware purchases, infrastructure upgrades, or modifications to ISP contracts made in response to OpenPacketLoss™ test results are done solely at their own risk and discretion.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of, or restrict or inhibit the use of, the Service by any third party.
Users explicitly agree NOT to use the OpenPacketLoss™ public cloud endpoints to:
- Intentionally flood, DDoS, or otherwise disrupt third-party networks, servers, or APIs.
- Automate continuous, high-frequency requests against our public endpoints in a manner that degrades the experience for other users.
- Engage in any form of malicious activity, unauthorized data harvesting, or abuse of the public endpoints.
Any violation of this policy will result in immediate IP-level restriction and permanent removal from the Service.
6. Third-Party Links and Services
The Service may contain links to third-party websites, advertisers, or services that are not owned or controlled by OpenPacketLoss™. We do not endorse or assume responsibility for any such third-party content, products, or services. Accessing third-party websites is done at your own risk, and this Terms of Service does not apply to your use of such sites.
7. Open Source Licensing
Portions of the OpenPacketLoss™ ecosystem, including the server-side software, are provided under open-source licenses. Your use of those specific components is subject to the terms of their respective open-source licenses as published on our official GitHub repository. This Terms of Service governs only the hosted Service and does not restrict your rights under any applicable open-source license.
8. Changes to the Terms of Service
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will attempt to provide reasonable notice prior to any new terms taking effect. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. We encourage you to review this page periodically for any changes.
